Continuing on theme journey into Success
Just to bring an update of all the new things I have been learning in the Partnership to Success Program.
We’ll briefly examine the Legal requirements of online marketer, as mandated by FTC (US), Canadian Competition Bureau, UK Information Commissioner and regulating bodies around the world.
At first glance it seems so restrictive that the Governments have insisted that all online businesses should have these in place:
- Anti Spam Policy
- Affiliate Disclosure
- Digital Millennium Copyright Act Notice
- Earnings Disclaimer
An Anti Spam Policy is clear declaration of what is the company’s policy of collecting and harvesting of email addresses or personal or business contact information. For this reason we’ve adopted a double opt-in system in order for a person to get added to our list.
To ensure that the website is not in violation of Anti Spam rules, here are a few things that must be done:
- Get consent and keep records.
- Indentify yourself or anyone you represent, Include contact information, name, telephone and email, this information must remain valid for 60 days after the message is sent.
- Include a way the individual can unsubscribe from your list, this should be at no cost to your subscriber.
- Ensure none part of your claim is false or misleading; this includes the senders identity, subject lines, website links, or any portion of your message in text or data.
Affiliate Disclosure: these guidelines for anyone who has gives endorsement or testimonials, to declare whether they have received compensation in return for their endorsement or testimonial.
Digital Millennium Copyright Act: is an act to protect intellectual property. It is imposed upon website owners and Internet Service Providers, if the contents posted on a particular website is in violation of copyrighting infringements and a takedown notice given to cease and desist.
Earnings Disclaimer: Any claim of earnings represents individual’s efforts and that those earnings are in no way a statement of guaranteed earnings.
Why is it necessary to add these standard declarations? Because everything must be done in a transparent manner to avoid misinterpretation.
In the world of online marketing there are many degrees of success and failures. Many online marketers in their efforts to make a sale, will make it seem so perfect, it requires no effort.
These statements add clarity and add protection from both sides of the coin. Because it is foolish to think as a marketer you do nothing and the money tap will flow. On the other side of the coin after selling the hype that marketer must get back to what is real and point out that these results are not typical and must make some claims of what typical results are.
An Online marketer must have these prominently placed and can be referenced from other documents. Not having these as an online marketer you are taking a risk
- Risk being fined
- Having their websites shut down.
In the Partnership program we’ve learned how to add a Word Press plug-in that takes care of all the legal pages we would require for our online business.
